1. License Grant
Subject to your continuous compliance with the terms of this EULA, Brocoly grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and execute the Brocoly mobile application on any Apple-branded iOS device (including iPhone, iPad, or iPod touch) that you own or control, solely for your personal, non-commercial use in accordance with the Apple App Store Terms of Service and Usage Rules.
Executable on authorized Apple hardware logged into your personal Apple ID or via Apple Family Sharing.
Licensed strictly to manage personal daily fresh meals, dietary profiles, delivery slots, and kitchen subscriptions.
2. Restrictions
You may not copy, modify, create derivative works of the App, sell, rent, lease, or sublicense the App, or reverse engineer, decompile, or disassemble the App, except to the extent that such activity cannot be restricted under applicable governing statutory law.
You may not reverse-engineer Apple Mach-O binaries, decrypt API endpoints, or probe meal dispatch routines.
No selling, redistribution, or white-labeling of the Brocoly application codebase or design assets.
Automated scrapers, bot orders, rate-limit bypassing, and simulated mock locations are prohibited.
Modifying runtime memory structures or bypassing iOS App Attest integrity checks results in instant termination.
3. Apple-Specific Terms
You acknowledge that this EULA is between you and Brocoly only, not with Apple Inc. Brocoly is solely responsible for providing maintenance and support services. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. Brocoly, not Apple, is responsible for addressing any claims relating to the App, including product liability, consumer protection, or intellectual property infringement claims. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA.
Sole Maintenance & Support Responsibility
Brocoly Foods Pvt. Ltd. retains exclusive duty to fix software bugs, patch iOS updates, and maintain dispatch APIs. Apple has zero obligation under any warranty theory.
Product Liability & Consumer Claims
Brocoly, not Apple, is accountable for addressing any claims relating to food safety standards (FSSAI), consumer rights, or proprietary recipe and software infringement.
Third-Party Beneficiary Rights
Upon your acceptance of these terms, Apple and Apple's subsidiaries will have the legal right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
Export & Legal Compliance Warranty
You represent and warrant that (i) you are not located in a country subject to a U.S. or Indian Government embargo, and (ii) you are not listed on any prohibited party list.
4. Termination
This EULA is effective until terminated. Your rights under this license will terminate automatically without notice from Brocoly if you fail to comply with any of the terms of this agreement. Upon termination of the license, you must immediately cease all use of the Brocoly application and permanently destroy or delete all copies of the App from all Apple devices in your custody or control.
